Open Net Expresses Regret over the Constitutional Court’s Decision That the Real Name System for Mobile Phones Is Constitutional

The Constitutional Court of Korea ruled against the complainants in a 7:2 decision on the mobile phone real-name system (2017HUNMA1209). Open Net had challenged the law in November 2017 arguing that the real-name system for mobile phones infringes users’ right to anonymous communications and informational self-determination. Nevertheless, it is noteworthy that the Constitutional Court explicitly acknowledged the right to anonymous communication for the first time.
